SKYWYE (“SKYWYE,” “we,” “us,” or “our”) operates a digital marketplace and collaboration platform that connects Brands, Creators, and Affiliate Partners for content creation, promotional campaigns, affiliate opportunities, gifting arrangements, and other commercial collaborations.

This Privacy Policy explains how SKYWYE collects, uses, processes, discloses, stores, retains, transfers, and protects Personal Information when an individual visits or uses the SKYWYE website, mobile or web applications, application programming interfaces, communication tools, payment features, and related products or services (collectively, the “Platform” or the “Services”).

This Privacy Policy applies to visitors, registered users, representatives of business users, and other individuals whose Personal Information is processed through the Platform. It does not apply to third-party websites, applications, or services that SKYWYE does not control.

By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy. Where applicable law requires consent, SKYWYE will request consent in an appropriate manner before carrying out the relevant processing.

2. Definitions

Affiliate Partner
a user who promotes products, services, campaigns, or offers and may earn performance-based compensation, commissions, or other rewards.
Brand
a business, agency, advertiser, organization, or authorized representative using the Platform to discover, engage, or manage Creators or Affiliate Partners.
Campaign
a project, brief, opportunity, affiliate offer, gifting arrangement, or promotional collaboration created or managed through the Platform.
Collaboration Agreement
the terms accepted between users for a Campaign, including deliverables, compensation, timing, revisions, approvals, usage rights, and other agreed conditions.
Creator
an individual or business that provides content, creative services, promotional services, or related deliverables.
Personal Information
information about an identifiable individual, or information that can reasonably be linked to an identifiable individual. The meaning may vary under applicable law.
Payment Provider
a third party that processes payments, payouts, refunds, identity verification, fraud screening, tax information, or related financial services, including Stripe where applicable.
Processing
any operation performed on Personal Information, including collection, organization, storage, access, use, analysis, disclosure, transfer, restriction, anonymization, or deletion.
User
any visitor, Brand, Creator, Affiliate Partner, account administrator, team member, or other person using the Platform.
User Content
content submitted, uploaded, transmitted, posted, or otherwise provided by a User, including portfolio materials, campaign assets, deliverables, messages, files, logos, reviews, and profile information.

3. Information We Collect

The information we collect depends on how you interact with SKYWYE, the features you use, the account type you select, and the information you choose or are required to provide.

3.1 Account and Registration Information

  • Name, display name, username, and password or authentication credentials
  • Email address, telephone number, country, region, and language
  • Account type and role
  • Business or company name, website, address, industry, and representative details
  • Information provided during onboarding, verification, or account setup

3.2 Profile and Marketplace Information

  • Profile photographs, biography, portfolio, websites, and public-facing descriptions
  • Creator niches, categories, skills, languages, location, availability, rates, compensation preferences, and experience
  • Brand profile information, logos, business descriptions, campaign history, and representative information
  • Social-media handles, links, follower counts, audience characteristics, reach, impressions, engagement rates, public content metrics, and similar statistics
  • Reviews, ratings, badges, account status, response rates, completed collaborations, and other marketplace indicators

3.3 Campaign and Collaboration Information

  • Campaign briefs, applications, pitches, invitations, offers, proposals, and Collaboration Agreements
  • Deliverables, drafts, revisions, deadlines, approvals, rejection reasons, change requests, and completion records
  • Compensation, usage rights, licensing terms, gifting arrangements, shipping information, and campaign status
  • Dispute records, reports, evidence, moderation decisions, and support communications

3.4 User Content and Files

  • Images, videos, audio, captions, documents, brand assets, logos, style guides, creative briefs, product information, portfolio materials, and campaign deliverables
  • Metadata associated with uploaded files, including file names, file types, timestamps, and technical information
  • Information contained in User Content, which may include Personal Information about you or third parties

3.5 Communications

  • Messages between Users sent through the Platform
  • Customer-support communications, complaints, reports, appeals, and dispute communications
  • Feedback, surveys, onboarding answers, and communications with SKYWYE personnel
  • Records of notices, invitations, approvals, and other Platform activity

3.6 Usage, Device, and Technical Information

  • Internet Protocol address, device identifiers, browser type, device type, operating system, language, and approximate location derived from IP address
  • Login history, access times, referring and exit pages, pages viewed, features used, clicks, searches, profile views, application activity, and navigation patterns
  • Crash reports, diagnostics, performance data, security logs, and authentication events
  • Cookie identifiers, advertising identifiers, and similar tracking information

3.7 Transaction, Billing, and Payout Information

  • Transaction amounts, payment status, payout status, refunds, fees, discounts, credits, chargebacks, and transaction identifiers
  • Billing name, billing address, billing country, currency, tax information, invoices, receipts, and accounting records
  • Limited payment method details received from Payment Providers, such as card brand, last four digits, bank account status, or payout account status

3.8 Identity, Business, and Financial Verification Information

  • Selfies or photographs used for identity matching, where required by a verification provider
  • Business registration records, beneficial ownership information, tax identification numbers, proof of address, and authorized representative information
  • Banking or payout information collected directly by a Payment Provider
  • Information used for know-your-customer, anti-fraud, sanctions, tax, or financial compliance purposes

3.9 Social Login and Connected Account Information

  • If you register or sign in through Google, Apple, Facebook, LinkedIn, or another third-party authentication service, we may receive the information that service is permitted to share and that you authorize
  • If you connect Instagram, TikTok, YouTube, Facebook, LinkedIn, or another social account or API integration, we may receive profile information, public content, audience statistics, engagement data, account identifiers, authorization tokens, and other data permitted by the provider and your settings

3.10 Affiliate and Performance-Tracking Information

  • Affiliate links, referral codes, click identifiers, impressions, conversions, order values, commission events, attribution data, device and browser information, and related campaign performance information
  • Information received from Brands, commerce platforms, affiliate networks, analytics providers, or other integrations used to verify performance and calculate compensation

3.11 Information from Other Sources

  • Information from other Users, service providers, social networks, public sources, fraud-prevention services, identity-verification providers, payment processors, and business partners
  • Information supplied by a Brand or agency about its authorized personnel, Creators, Affiliate Partners, campaign participants, or customers where permitted by law

You should not provide Personal Information about another person unless you have the authority and any required consent to do so.

4. Sensitive Information and Biometrics

Certain information processed for identity, payment, tax, fraud-prevention, or compliance purposes may be considered sensitive under applicable law. SKYWYE will limit the use of such information to purposes that are reasonably necessary and legally permitted.

SKYWYE does not intend to collect or use biometric identifiers for independent identification or surveillance. A third-party identity-verification provider may use facial comparison or similar technology to confirm that an identification document matches a submitted photograph or selfie. Where this occurs, the provider’s terms and privacy notice apply, and SKYWYE will provide additional notice or obtain consent where legally required.

Users should not upload health information, precise financial credentials, government identifiers, or other highly sensitive information into public profiles, campaign materials, or Platform messages unless expressly requested through an approved secure process.

  • To detect, investigate, prevent, and respond to fraud, fake engagement, abuse, spam, account compromise, copyright infringement, security incidents, and violations of Platform policies

  • To send account, security, payment, collaboration, legal, and other service-related communications
  • To send marketing communications where permitted by law and according to your preferences

7. AI, Automated Systems, and Recommendations

SKYWYE may use artificial intelligence, machine learning, rules-based systems, and other automated technologies to support:

  • Creator, Brand, Affiliate Partner, Campaign, and opportunity recommendations
  • Search ranking, relevance, and marketplace discovery
  • Fraud, fake engagement, suspicious payment, spam, abuse, and security detection
  • Content categorization, moderation support, analytics, and workflow automation
  • Customer-support assistance, campaign insights, and product improvement

These systems may analyze profile data, campaign information, usage activity, public social statistics, transaction signals, and other relevant information. SKYWYE does not intend to use automated systems to make decisions that produce legal or similarly significant effects without meaningful human involvement, appropriate safeguards, and any notice or consent required by law.

SKYWYE may use de-identified or aggregated information to train, test, evaluate, or improve Platform features. We will not use private messages or confidential campaign materials to train general-purpose third-party AI models unless we provide appropriate notice, have a lawful basis, and implement suitable contractual and technical protections.

8. User Content and Responsibility

User Content is distinct from SKYWYE’s own content and may include Personal Information. Users are responsible for ensuring that User Content is lawful, accurate, appropriately licensed, and does not violate the privacy or intellectual-property rights of others. SKYWYE may process User Content to host, transmit, display, review, moderate, secure, and administer the Platform, and as otherwise permitted by the Terms of Service and applicable Collaboration Agreements. Public or marketplace-visible User Content may be viewed, copied, or shared by others, so Users should not include information they do not wish to disclose.

9. Public Profiles, Search Visibility, and User Controls

SKYWYE is designed to help Users discover and evaluate one another. Depending on Platform settings and account type, profile information may be visible to other registered Users, selected account types, the general public, and search engines where public indexing is enabled.

Visible information may include a display name, profile photograph, business name, logo, biography, portfolio, categories, social links, public statistics, ratings, reviews, campaign history, badges, and other information chosen for display.

Where available, Users may control whether their profile is public or limited, whether certain details appear in search, and who may contact them. These controls may not remove information already copied, cached, or independently obtained by others. SKYWYE may retain limited profile information after account closure where necessary for transaction integrity, fraud prevention, legal compliance, or dispute records.

10. Creator, Brand, and Affiliate Analytics

SKYWYE may provide Users with analytics such as profile views, impressions, applications, invitations, response rates, campaign performance, clicks, conversions, sales, commission events, engagement metrics, or audience statistics. Some statistics may be supplied by Users, retrieved from connected platforms, received from third parties, or calculated by SKYWYE. Such statistics may be delayed, estimated, incomplete, or affected by third-party data availability.

11. How We Share Personal Information

SKYWYE may disclose Personal Information as reasonably necessary for the following purposes:

11.1 Other Users

We may share profile, application, campaign, transaction-status, communication, and collaboration information between Brands, Creators, Affiliate Partners, agencies, and authorized team members where needed to support discovery, evaluation, communication, and performance of a Collaboration Agreement.

11.2 Payment and Verification Providers

We may share information with Stripe or other Payment Providers to process payments, payouts, refunds, chargebacks, identity checks, tax reporting, fraud screening, and financial compliance.

11.3 Technology and Service Providers

We may use service providers for cloud hosting, data storage, authentication, analytics, communications, email delivery, customer support, security, fraud prevention, identity verification, payments, content delivery, monitoring, backups, and other infrastructure. Examples may include AWS, Google Cloud, Microsoft Azure, SendGrid, Mailchimp, Resend, Amazon SES, Google Analytics, Mixpanel, PostHog, Microsoft Clarity, and similar providers, depending on what SKYWYE implements.

11.4 Advertising and Measurement Partners

Where permitted by law and subject to applicable consent requirements, SKYWYE may disclose or allow collection of limited identifiers, cookie data, usage information, and conversion events through technologies such as Meta Pixel, LinkedIn Insight Tag, TikTok Pixel, and Google Ads.

11.5 Professional Advisers

We may disclose information to lawyers, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary.

11.6 Legal, Safety, and Regulatory Disclosures

We may preserve, access, or disclose information where required or permitted by law, including in response to lawful requests from courts, regulators, law-enforcement agencies, tax authorities, or government bodies, or where reasonably necessary to investigate fraud, protect safety, enforce agreements, or defend legal claims.

11.7 Business Transfers

Information may be disclosed or transferred in connection with a financing, merger, acquisition, reorganization, insolvency, sale of assets, or similar transaction. A successor will be required to handle Personal Information consistently with this Privacy Policy until it lawfully provides a revised policy.

11.8 With Consent or at Your Direction

SKYWYE does not sell Personal Information for monetary consideration. 12. Payment Processing and Stripe

SKYWYE may use Stripe, including Stripe Connect, or other Payment Providers to facilitate payment collection, payout, refunds, identity verification, fraud prevention, tax reporting, and related services. When you use payment functionality, information may be provided directly to the Payment Provider or transmitted by SKYWYE to that provider.

Payment Providers may process personal, business, billing, banking, transaction, tax, government-identification, and verification information under their own terms and privacy notices. SKYWYE may receive transaction identifiers, amounts, payout status, refund status, fee information, limited payment method details, verification status, and other information needed to administer Platform transactions.

SKYWYE generally does not receive or store complete payment-card numbers or complete bank-account credentials when those details are collected directly by a PCI DSS-compliant Payment Provider. Users should review the applicable Payment Provider’s privacy notice before using payment services.

13. Communications and Lawful Monitoring

SKYWYE may provide messaging, notifications, support tools, and other communication features. Communications made through the Platform may be stored, processed, and reviewed by automated systems or authorized personnel where reasonably necessary to:

  • Deliver and maintain communication functions
  • Prevent spam, fraud, harassment, abuse, or security threats
  • Investigate complaints, copyright claims, reports, and disputes
  • Verify completion, acceptance, payment, or other collaboration activity
  • Enforce Platform rules and protect Users
  • Comply with legal obligations and lawful requests

Users should treat Platform communications as official records of Platform activity and should avoid sending unnecessary government identifiers, complete payment credentials, or other sensitive information through messages.

14. Marketing and Communication Preferences

SKYWYE may send service-related communications concerning account activity, security, payments, collaborations, policy changes, and other essential Platform matters. These messages are necessary for operation of the Services and generally cannot be opted out of while an account remains active.

Where permitted by law, SKYWYE may also send marketing by email, SMS, push notification, browser notification, or in-app message. Marketing may include product updates, new features, campaigns, opportunities, events, promotions, research, or SKYWYE news. Where consent is required, SKYWYE will obtain it before sending marketing communications.

Users may unsubscribe through the link or setting provided, adjust notification preferences where available, or contact SKYWYE. Opting out of one communication channel may not opt the User out of all channels.

15. Cookies and Similar Technologies

SKYWYE may use cookies, local storage, software development kits, pixels, tags, device identifiers, and similar technologies to operate and secure the Platform, remember preferences, understand usage, measure performance, and support advertising or attribution.

Users may manage cookies through browser settings and any cookie-preference tool provided by SKYWYE. Blocking cookies may affect Platform functionality.

16. Do Not Track and Global Privacy Controls

Some browsers provide “Do Not Track” signals. Because there is no universally accepted standard for responding to those signals, the Platform may not respond to them in all circumstances. Where required by applicable law, SKYWYE will recognize legally valid browser-based opt-out signals, such as Global Privacy Control, for relevant processing activities.

17. Third-Party Services and Links

The Platform may integrate with or link to payment providers, social networks, authentication services, commerce platforms, affiliate networks, analytics tools, and other websites or services. Third parties process information under their own terms and privacy practices. Once you leave SKYWYE or interact directly with a third party, this Privacy Policy may no longer apply. SKYWYE is not responsible for privacy practices of services it does not control.

18. Data Retention

SKYWYE retains Personal Information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Platform, maintain transaction and collaboration records, resolve disputes, prevent fraud, enforce agreements, comply with tax and accounting obligations, and establish or defend legal claims.

Retention periods vary depending on the type of information, legal requirements, sensitivity, risk, contractual commitments, and operational needs. Examples include:

  • Account and profile information retained while an account is active and for a reasonable period after closure
  • Transaction, payout, tax, invoice, and accounting records retained for periods required by applicable law
  • Campaign, approval, dispute, moderation, and communication records retained as needed for contract enforcement, safety, fraud prevention, and legal claims
  • Security logs and fraud signals retained for a reasonable period based on risk
  • Cookie and analytics data retained according to the applicable tool settings and consent requirements

When information is no longer required, SKYWYE may delete it, anonymize it, aggregate it, or securely dispose of it. De-identified or aggregated information that can no longer reasonably identify an individual may be retained and used for lawful business purposes.

19. Account Closure and Deletion Requests

Users may request account closure or deletion through available account controls or by contacting SKYWYE. After verifying the request, SKYWYE will begin the deletion or anonymization process within a reasonable period and will respond within the timeframe required by applicable law, generally within 30 to 45 days where those timeframes apply.

Account closure does not require immediate deletion of all information. SKYWYE may retain information where reasonably necessary or legally permitted, including:

  • Transaction, payment, payout, tax, and accounting records
  • Campaign, Collaboration Agreement, approval, dispute, and chargeback records
  • Fraud-prevention, sanctions, security, and abuse-prevention information
  • Records required to establish, exercise, or defend legal claims
  • Information subject to legal preservation obligations, court orders, government requests, or active investigations
  • Information retained in backups until it is overwritten through the normal backup cycle

Public content previously shared or copied by other Users may remain available outside SKYWYE’s control. SKYWYE may retain a limited record that an account was closed or restricted to prevent fraud or repeated violations.

20. Security

SKYWYE uses reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, loss, theft, misuse, disclosure, alteration, or destruction. Safeguards may include:

  • Encryption in transit through TLS/HTTPS and encryption at rest where appropriate
  • Role-based access controls and least-privilege access
  • Password protection, authentication controls, and optional or required multi-factor authentication where available
  • Secure cloud hosting, backups, redundancy, and recovery procedures
  • Logging, audit trails, monitoring, fraud detection, and security alerts
  • Vendor assessment, contractual confidentiality and data-protection obligations

SKYWYE maintains procedures to assess and respond to suspected security incidents. Where a breach of security safeguards creates a legally defined risk requiring notification, SKYWYE will notify affected individuals, regulators, or other authorities as required by applicable law. Notification timing, content, and method will depend on legal requirements and the circumstances of the incident.

22. International Data Transfers and Storage

SKYWYE is intended for international use. Personal Information may be processed or stored outside your province, state, or country, including in Canada, the United States, the European Economic Area, the United Kingdom, or other jurisdictions where SKYWYE or its service providers operate.

Privacy laws in other jurisdictions may differ from those in your location, and information may be subject to lawful access by courts, regulators, law-enforcement agencies, or governmental authorities in those jurisdictions. Where required, SKYWYE will use appropriate safeguards, such as contractual protections, approved transfer mechanisms, and security controls.

23. Your Privacy Rights and Choices

Depending on your location and applicable law, you may have some or all of the following rights:

  • Access the Personal Information SKYWYE holds about you
  • Request correction of inaccurate or incomplete information
  • Request deletion of eligible information
  • Withdraw consent where processing is based on consent

Where Canadian privacy law applies, including the Personal Information Protection and Electronic Documents Act and applicable provincial privacy laws, individuals may request access to Personal Information under SKYWYE’s control, request correction, withdraw consent subject to legal or contractual restrictions, and challenge SKYWYE’s compliance. 25. European Economic Area and United Kingdom

27. Accuracy of Information

Users are responsible for providing accurate, complete, and current information and for updating account details when they change. SKYWYE may take reasonable steps to ensure that Personal Information used for material decisions is sufficiently accurate, complete, and current.

28. Children’s Privacy

The Platform is not intended for individuals under 18 years of age, and Users must be at least 18 to create an account or enter collaborations through SKYWYE. SKYWYE does not knowingly collect Personal Information from children. If SKYWYE becomes aware that an ineligible individual has provided Personal Information, it will take reasonable steps to delete the information promptly and close the relevant account, subject to legal retention requirements.

SKYWYE is responsible for Personal Information under its control and will designate an individual to oversee privacy compliance, policies, requests, training, vendor management, incident response, and complaints.
